AnnotationIn one of the twentieth thesis American historian Timothy Snyder in the Tyranny, on the need to protect the values of liberal democracy from authoritarian tendencies, the author draws attention to intentional misuse of conceptual means. Specific points on the notion of exceptional condition, that in political philosophy was introduced and in the context of the theory of the policy advocated by the German lawyer Carl Schmitt. Interpretation of Schmitt key categories, we will show the reasons why the theory of the exception is contrary to the principle of the rule of law and why can we attributed to the ideological dimension. Using an analytic-synthetic method, we will try to defend the thesis that the exception as an extreme, boundary, and existentially decisive status admits confrontation and hard power.
