Although it should be noted that in recent years there has been a renewed intention in many countries to move closer to the written civil procedure. There is also an international element where proceedings before the Court of Justice of the European Union or the ECHR are mainly written. The broad approach to the principle of orality in the past, which ascribed it to ideological significance, seems to be outdated. Each of the two alternative forms of process communication serves to better flow of the process in its own way. As we have seen, the application of the principle of orality in the civil process has obvious advantages, it should be pointed out that, in principle, it must be applied in the stages and activities in which it is effective; without necessarily excluding the document from the process as a means of helpful, sometimes even necessary. Princíp ústnosti civilného konania je rešpektovaný a predominantný vo väčšine krajín Európy. Hoci v posledných rokoch silnejú tendencie posunúť na bližšie ku konaniu písomnému. Právna doktrína považuje za ústne konanie taký postup súdu, kde prevládajú ústne prednesy doplnené použitím písomných dokumentov Nie každé konanie, kde sa vyskytujú ústne prednesy a je tu ústna komunikácia môže byť jednoznačne považované za ústne. Proces čisto ústny neexistuje, v dnešnej dobe ide o kombináciu ústnosti a písomnosti, ktoré sa majú dopĺňať. Nesmieme zabúdať na vplyv moderných technológii, ktoré menia doterajší rozmer princípu ústnosti
