The employer's control mechanism and its implementation in the workplace

The employer's control mechanism and its implementation in the workplace / Zuzana Homer. -- Interference with the privacy of employees in the workplace represents one of the most significant threats to a natural person's right to a family and private life, which is protected by national and international treaties. For employers, such intrusions into the privacy of their employees most often take the form of a certain type of “control mechanism,” the definition of which, however, is absent from current Slovak legislation. Similarly, a clear description of the premises on which the employer may introduce such a control mechanism, or on which this is unacceptable with regard to the protection of the employee's privacy, is also missing. Through the author's own legal theory and the legal arguments contained in court decisions, they examine the theoretical and practical limits of the employer's ability to introduce such a control mechanism into the workplace. On the grounds of the methodological procedures outlined, legislative changes to the relevant provisions of the Labor Code are recommended, the character of which are based on the author's legal arguments within the framework of applicable legislation and case law. The aim of this scientific article is to elicit expert discussion on the legal theory anchoring the employer's ability to introduce a control mechanism in the workplace, including the practical dimensions of the geographical delimitation of the monitored areas.
