Chapter 10. -- Slovak courts have consistently applied European private international law (EU PIL) instruments since the Slovak Republic joined the EU on 1 May 2004. The volume of judicial decisions applying EU PIL is continuously growing. As a general remark, it can be established that overall knowledge of EU PIL and the awareness of the CJEU’s case law has improved in Slovakia. Still, some more training and information support could be of use in this regard. The characterization of legal relations for the purposes of applying EU PIL is one of the most difficult challenges faced by Slovak courts. This causes uncertainty as to which EU PIL should be applied in the given case. Perhaps due to the uncertainty in the characterization of contractual and non-contractual relations, the practice of the Slovak courts is significantly heterogeneous in these matters. The judicial practice in family matters is much more coherent. The application of EU PIL is still heavily influenced by the notions of domestic law.
